## In a kitchen, the working day is rarely 9am to 6pm

Lunch and dinner call for split shifts, closing often ends after midnight, and public holidays are full-house days. Building the roster by hand, checking that no one goes without their 11 hours of rest and, at the end of the month, separating night hours and public holiday hours for the accountant takes up hours that are needed on the floor.

## What the law requires

### Record of working time

The employer must keep time records for all employees, including those exempt from set working hours and those who work away from the premises, with start and end times and breaks. The records must be available for immediate inspection and kept for five years. Failing to keep time records is a serious administrative offence, with fines between €612 and €9,690, depending on turnover and the degree of fault.

Article 202 of the Labour Code

### 11 hours of rest between two working days

Between two daily periods of work, the employee is entitled to at least 11 consecutive hours of rest, save for the exceptions provided for in the law or in a collective agreement.

Article 214 of the Labour Code

### Night work while the establishment is open to the public

Unless a collective agreement defines a different period, night work is work performed between 10pm and 7am. As a rule, it is paid with a 25% supplement, but the law does not require it in food or beverage establishments and in tourist establishments during the hours they are open to the public, unless the applicable collective agreement provides for it. Check what yours says.

Articles 223 and 266(3) of the Labour Code

### Work on a public holiday

An employee who works on a public holiday, in a company that is not required to close on that day, is entitled to compensatory rest of half the hours worked or to a 50% supplement on the corresponding pay, at the employer's choice.

Article 269(2) of the Labour Code

### A limit of 48 hours per week, on average

The average weekly working time, including overtime, cannot exceed 48 hours, calculated over a reference period of four months, unless the collective agreement sets a different one, of up to 12 months.

Article 211 of the Labour Code

A summary of the Portuguese Labour Code and, where stated, Law 102/2009. It does not replace the collective agreement for your sector or legal advice.

## How TeamYo helps

Pro plan

### Shift types and split shifts

Create reusable shift types, with one or more blocks on the same day, for example 10am-2pm and 6pm-10pm. The gap in a split shift does not count as an early departure.

Pro plan

### Automatic roster validation

Before publishing, TeamYo checks the rest between shifts (11 hours, as in Article 214 of the Labour Code), the hours per week (48 by default), the hours per day and consecutive working days (12 hours and 6 days by default, which the company adjusts to its schedule and collective agreement) and conflicts with absences. A roster that does not comply is not published.

Pro plan

### Night hours

Set the night period (10pm to 7am by default) and the premium. TeamYo counts night hours from actual clock-ins, not from the planned shift.

Pro plan

### Work on public holidays

Hours worked on a public holiday are counted separately, with the premium you set.

Pro plan

### Missing clock-in alert

When the minutes you set have passed after the start or end of the shift without a clock-in, TeamYo notifies the employee and their manager, by email, in the app or both. The waiting time and the channel are set separately for the employee and for the manager, between 5 minutes and 12 hours.

Pro plan

### Time sheet sent to your accountant automatically

On the day of the month you choose, between 1 and 28, the accountant receives the previous month's Excel file by email: detail per day, summary per person, days to resolve and absences, with night and public holiday hours.

## Illustrative example: a restaurant serving lunch and dinner

The manager creates a split shift type, from 10am to 2pm and 6pm to 10pm, and another for closing, until 1am. When building the week's roster, TeamYo warns that a person who closes at 1am and starts at 10am the next day gets less than 11 hours of rest, and the roster is only published once it has been corrected.

The team clocks in on their phones. On the day of the month you choose, the accountant receives the previous month's Excel file, with night hours and public holiday hours shown separately.

## Frequently asked questions

**Does the break in a split shift count as leaving early?**

No. In a shift type with two blocks, for example from 10am to 2pm and 6pm to 10pm, the break between the blocks does not count as leaving early.

**Does a restaurant have to pay the 25% supplement for night hours?**

In food or beverage establishments, during the hours they are open to the public, the law does not require the 25% supplement, unless the applicable collective agreement provides for it (Article 266(3) of the Labour Code). In TeamYo, you set the night period and the premium according to your collective agreement, and night hours are counted from actual clock-ins.

**Does TeamYo prevent rosters without the 11 hours of rest?**

Yes. Before publishing, TeamYo checks the rest between shifts, the hours per week and per day, consecutive days and conflicts with absences. A roster that does not comply is not published until it is corrected.

**How much does it cost?**

Leave and absence management is free for up to 5 employees, with no time limit. The digital time clock, shifts and payroll calculations are part of the Pro plan, at €1.70 per employee/month billed annually or €2.00 billed monthly. For teams of 25 or more employees, there is the Enterprise plan, priced on request.
