## The team is on site, not in the office

Teams move from site to site, technicians spend the day travelling, and paper records reach the office days later, if at all. Portuguese law requires you to record the working time of those who work away from the premises and to have that record signed and at the company within 15 days.

## What the law requires

### Record of working time

The employer must keep time records for all employees, including those exempt from set working hours and those who work away from the premises, with start and end times and breaks. The records must be available for immediate inspection and kept for five years. Failing to keep time records is a serious administrative offence, with fines between €612 and €9,690, depending on turnover and the degree of fault.

Article 202 of the Labour Code

### Work away from the company premises

When work is performed away from the company premises, the employer must ensure that the employee signs the record as soon as they return to the company, or sends it signed, so that the company has it within 15 days of the work being performed.

Article 202(3) of the Labour Code

### 11 hours of rest between two working days

Between two daily periods of work, the employee is entitled to at least 11 consecutive hours of rest, save for the exceptions provided for in the law or in a collective agreement.

Article 214 of the Labour Code

### A limit of 48 hours per week, on average

The average weekly working time, including overtime, cannot exceed 48 hours, calculated over a reference period of four months, unless the collective agreement sets a different one, of up to 12 months.

Article 211 of the Labour Code

A summary of the Portuguese Labour Code and, where stated, Law 102/2009. It does not replace the collective agreement for your sector or legal advice.

## How TeamYo helps

Pro plan

### GPS clock-in with geofencing by location

Each location can have a clock-in zone, with a radius between 20 metres and 5 kilometres. A clock-in outside the zone is refused. GPS collection and geofencing are switched on in the company settings.

Pro plan

### Work modes: remote work and travel

When clocking in, the employee indicates whether they are working remotely or travelling. The company chooses the modes it uses and who can clock in outside the premises.

Pro plan

### Geofencing exemption per employee

The administrator can exempt people who work outside the premises from the clock-in zone. The change is recorded, with who made it and when.

Pro plan

### Automatic clock-ins at the planned time

For people with fixed hours, TeamYo records the start and end at the time of the published shift or the weekly schedule. It does not clock in during annual leave, approved absences or days off, and only fills in missing clock-ins. It is switched on per employee.

Pro plan

### Log of refused clock-in attempts

Each refused attempt is recorded with the reason, the distance to the nearest clock-in zone and the location on the map.

Pro plan

### Retention and automatic purging of location data (GDPR)

The coordinates of each clock-in are deleted automatically at the end of the period you set: 90 days by default, from 1 day to 10 years. The record of working time is kept.

## Illustrative example: a company with several sites in progress

Each site is a location with a clock-in zone, with a radius between 20 metres and 5 kilometres. The team clocks in on their phones on arrival at the site, and a clock-in outside the zone is rejected and recorded with the distance.

Technicians who spend the day between clients clock in while travelling, and the coordinates of each clock-in are deleted automatically at the end of the period you set.

## Frequently asked questions

**Can I have a clock-in zone per site?**

Yes. Each site can be a location with its own clock-in zone, with a radius between 20 metres and 5 kilometres.

**What about technicians who are always travelling?**

When clocking in, they indicate that they are travelling. The company chooses who can clock in away from the premises, and those clock-ins are not checked against the clock-in zone.

**What happens to the location data?**

The coordinates of each clock-in are deleted automatically at the end of the period you set: 90 days by default, from 1 day to 10 years. The record of working time is kept.

**How much does it cost?**

Leave and absence management is free for up to 5 employees, with no time limit. The digital time clock, shifts and payroll calculations are part of the Pro plan, at €1.70 per employee/month billed annually or €2.00 billed monthly. For teams of 25 or more employees, there is the Enterprise plan, priced on request.
